TERMS OF SERVICE

These Terms of Service ("Terms") constitute a legal agreement between the ImagineIf platform ("Platform", "Service", "we", "us", "our"), operated individually by Tugay Pala, and you ("User", "you", "your"). By using the Platform, you are deemed to have accepted these Terms.
ImagineIf is a creative writing and social interaction platform where users create collaborative story chains, contribute to them, and enrich them with AI-generated visuals.
If you log in with your Google account, Google's privacy policy and terms of service also apply. Data we receive from Google is processed in accordance with our Privacy Policy.
The intellectual property rights of the original text content (story segments, comments) you create on the Platform belong to you. However, by publishing this content on the Platform, you grant us the following license:
You grant ImagineIf a worldwide, non-exclusive, royalty-free license to display, distribute, reproduce, modify (for formatting and editing purposes), sublicense, and make your user content available to the public on the Platform. This license ends within a reasonable technical period if you delete your account or request the removal of your content from the Platform. However, shares made by third parties or cached copies during this period are outside this scope. This license is limited to the following purposes:
Story chains are joint works created with the contribution of multiple users. Each contributor owns the intellectual property rights to their own segment. No user can claim exclusive rights over the chain as a whole.
Images generated by AI are evaluated within the framework of existing AI and copyright legislation. AI images are provided as part of the Platform Service, and exclusive ownership rights cannot be claimed over these images. The Platform reserves the right to offer AI images as part of the service.
ImagineIf's logo, design, software, interface, and other intellectual property assets belong to ImagineIf and are protected by copyright. Unauthorized use is prohibited.

The Platform offers basic features for free. Free accounts include certain usage limits and features.
Premium subscription offers additional features and increased usage limits. Subscription fees are billed monthly or annually depending on the plan you choose. For detailed conditions, please see our Subscription Terms and Refund Policy.
Payment transactions are carried out by Paddle as the Merchant of Record. Paddle processes your payment information within the framework of its own privacy policy and security standards. We do not directly store your credit card or bank information.
We offer a 30-day money-back guarantee on all new Premium subscriptions. You may cancel your subscription and receive a full refund within 30 days of the purchase date without giving any reason. For detailed conditions, please see our Subscription Terms and Refund Policy.
The Platform evaluates user content using AI-based automated moderation systems. These systems work to detect and block content that violates Community Guidelines.
We reserve the right to remove content that violates the Terms of Service or Community Guidelines, creates a legal requirement, violates the rights of third parties, or threatens platform security, with or without notice.
You can close your account at any time via your settings or by sending us an email. When the account is closed:
We may suspend or permanently close your account in case of repeated or serious violations of the Terms of Service, suspicion of illegal activity, behavior that threatens the safety of other users, failure to fulfill payment obligations, or account inactivity for more than 12 months.
The Platform is provided "as is" and "as available." We do not provide any guarantee that the service will be uninterrupted, error-free, or secure.
To the maximum extent permitted by applicable law, ImagineIf is not responsible for direct, indirect, incidental, special, or consequential damages arising from the use of the Service. Our total liability, if any, is limited to the total amount you paid us in the last 12 months. This limitation does not override the legal rights of consumers.
We do not accept any warranty or responsibility for user content and AI-generated images on the Platform.
You agree to indemnify and hold ImagineIf, its directors, employees, and representatives harmless from all claims, lawsuits, damages, and expenses arising from your use of the Service, your violation of the Terms, or your violation of the rights of third parties.
ImagineIf does not accept responsibility if it cannot provide the Service or fulfill its obligations due to events beyond its control (natural disasters, war, epidemics, government decisions, internet infrastructure failures, cyber attacks, power outages, and similar force majeure events). During the force majeure period, the Platform's obligations are suspended.
These Terms shall be interpreted and implemented within the framework of the laws of the Republic of Turkey.
In case of any dispute, an amicable solution will be sought first. If the parties cannot reach an agreement within 30 days, the dispute shall be resolved by Istanbul Courts and Enforcement Offices.
Consumers residing in the European Union also reserve the right to file a lawsuit in the courts of the country where they reside. They can also apply for online dispute resolution via the EU Online Dispute Resolution Platform (ec.europa.eu/odr).
We reserve the right to update these Terms from time to time. Significant changes will be notified at least 30 days in advance.
If any provision of these Terms is found to be invalid or unenforceable, the validity of the remaining provisions shall not be affected.
Our failure or delay to exercise any right does not mean we have waived that right.
You cannot transfer your rights or obligations under these Terms without our prior written consent.
These Terms, along with the Privacy Policy, Community Guidelines, Cookie Policy, AI Usage Policy, Acceptable Use Policy, and Subscription Terms, constitute the entire agreement between the parties.
